Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Kya’s customer success platform, websites, and related services (the “Service”). By using the Service, you agree to these Terms.

The Service

Kya provides software that connects to your systems, monitors customer accounts, and helps your team coordinate and act on customer success work. We may update or improve the Service over time.

Accounts

You are responsible for your account, for keeping credentials secure, and for activity that occurs under your workspace. You must provide accurate information and keep it up to date.

Customer Data and integrations

You retain ownership of the data you load into or connect to Kya (“Customer Data”). You grant Kya the rights needed to host, process, and display Customer Data in order to provide the Service. You are responsible for ensuring you have the authority and any required permissions or notices to connect third-party systems — such as your CRM, support, product analytics, email, and billing tools — and to allow Kya to process the data they contain.

Third-party services

The Service integrates with third-party products you choose to connect. Those products are provided by their respective vendors and governed by their own terms; Kya is not responsible for third-party services or their availability. Disconnecting a service stops further syncing.

Service providers and infrastructure

Kya uses third-party service providers to operate, secure, support, and improve the Service. You authorize Kya to engage these providers and to host, process, transmit, and store Customer Data and other information through their services as reasonably necessary to provide the Service. Our current providers and their functions include:

  • Vercel — application hosting.
  • Supabase — database, authentication, and object storage.
  • OpenRouter — routing AI requests to available model providers.
  • The model providers selected through OpenRouter — processing AI requests and generating model outputs. The provider may vary based on the model selected, routing configuration, and availability.
  • Fly.io — hosting supporting application services.
  • Sentry — error monitoring, diagnostics, and service reliability.
  • PostHog — product analytics and AI request metadata. Collection of prompt content is disabled by default.
  • Resend — transactional email delivery.
  • Stripe — billing and payment processing.

These providers may process Customer Data, account information, usage data, or technical metadata only to the extent needed for their stated functions and subject to their agreements with Kya. We may replace a provider or engage additional providers as the Service evolves. Our Privacy Policy describes how we and our service providers process personal information.

AI features

The Service produces automated and AI-generated outputs, including summaries and recommended actions. These outputs may contain errors and are provided for your review and judgment. They are not professional, legal, financial, or other regulated advice, and you are responsible for the decisions you make using the Service.

Acceptable use

  • Do not use the Service in violation of applicable law or the rights of others.
  • Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
  • Do not upload data you are not authorized to share or that contains malicious code.
  • Do not use the Service to send unlawful, infringing, or abusive content.

Fees

Paid use of the Service is governed by the order form or plan you select. Fees are non-refundable except as required by law or as expressly stated in your order.

Intellectual property

Kya and its licensors own all rights in the Service, including its software, design, and content, excluding Customer Data. These Terms do not grant you any rights in the Service other than the limited right to use it.

Confidentiality

Each party may receive confidential information from the other. The receiving party will protect it and use it only as needed to perform under these Terms.

Warranty disclaimer

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Kya disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, or consequential damages, and Kya’s total liability arising out of or relating to the Service will not exceed the amounts you paid to Kya in the twelve months before the event giving rise to the claim.

Term and termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or as required by law. On termination, your right to use the Service ends and we will delete or return Customer Data as described in our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above; your continued use of the Service constitutes acceptance.
